Eser has found main sponsor – new trouble with trademark rights

Finally some good news for KFC Uerdingen. Mehmet Eser promised a main sponsor and a jersey sponsor for the game against MSV Duisburg and kept his word.

Mehmet Eser, owner of the M-Soccermanagement agency and also an advisor to the regional league club KFC Uerdingen, which is in crisis off the pitch, has recently been keen to communicate via the Uerdingen fan radio station “Radio BlauRot”.

Last week, the powerful man in the KFC background said to the radio: “I have two important appointments on Tuesday and Wednesday with major sponsors who want to be on the shirt. The amount has not yet been determined. I negotiate, give my advice, then the board of directors has to decide. We will decide on one of the two dates. I can assure you that we will play with a main sponsor in the home game against MSV Duisburg (Saturday, November 23, editor’s note). It’s a sum of over €250,000. If it doesn’t work out, I promise that I will put my money where my mouth is with my agency M-Soccermanagement – also with a sum of over €250,000.”

And, lo and behold, businessman and player agent Eser has followed up on his words with action. A sponsor is ready. The only ‘hurdle’: the board of directors and the administrative board still have to agree to the deal at the beginning of the week.

It is said to be the Mercedes-Benz-Herbrand Group, which has a branch in Krefeld-Gartenstadt.

Eser, who confirmed the possible Mercedes sponsorship to the “Westdeutsche Zeitung” on Saturday evening, said of the main sponsor found: “That’s a big name. But KFC was once big and should now continuously grow bigger again. Now the board and the administrative board have to agree to the contract on Monday.”

Eser in the “WZ”: “Mercedes wants to go on the journey with us, we hope for a successful cooperation.”

But it seems that KFC Uerdingen just can’t get any peace after this good news. Because there is trouble over the trademark rights.

KFC Uerdingen demands deletion or transfer of trademark rights

The club writes on its homepage: “It has come to the club’s attention that Frankfurt-based Radio BlauRot Entertainment GmbH and its managing director Bernd Limberg have recently secured trademark rights to the club logo and the word mark ‘KFC Uerdingen 05’.

This was done without the club’s consent and encroaches on its exclusive rights. The club can therefore invoke older business designations within the meaning of § 5 MarkenG.

Contrary to rumors, the club’s trademark rights were never freely available to third parties and the club was not without protection against trademark usurpation.

The board is obliged to avert damage from the association and has therefore decided to ask Radio BlauRot Entertainment GmbH and its managing director Bernd Limberg to either have the trademarks deleted or to transfer them to the association.

Insofar as the trademark had been transferred, the board has offered to waive all costs and even to reimburse the costs incurred by BlauRot Entertainment GmbH. The association will not incur any costs as a result of the legal proceedings.”
